Social Club Owners Report Police Abuses: «They Acted Without Judicial Orders and with Violence»

Managers and owners of several social clubs claim that in six of the nine police interventions in recent months, the agents acted without authorization and violated their rights. As a result, the social clubs have filed several complaints with the relevant courts.

Owners and managers of various social clubs have reported a series of police interventions that they consider abusive, occurring in the last two months. In at least six of the nine joint operations carried out by the National Police and the Local Police of Arona, law enforcement allegedly acted without the corresponding judicial authorization, entering what those affected consider a clear violation of the right to the inviolability of the home, arguing that the premises where the clubs operate are social homes.

According to the managers, only in three of the nine cases did the police have a judicial order for the search of the facilities; however, the validity of the judicial resolutions issued is still questioned. «The orders issued by the judge are identical, despite being completely different cases. It is evident that there has not been a proper analysis of each situation,» comments one of the affected owners. Furthermore, in one of these cases, although there was an order, the case has already been archived, raising doubts about the legality of the other interventions.

The other six affected clubs faced interventions without judicial authorization, a practice that the managers understand to be illegal, which is why they are filing the corresponding complaints, having already submitted two and currently working on a third. «The premises where our clubs carry out their purpose is a social home, and the police cannot enter without authorization unless one of the three conditions is met: that there is flagrant crime, that there is a judicial order, or that the owner or manager allows access. None of these requirements have been met in our cases,» explain the owners, who hope that the cases will be archived and those responsible will be held accountable.

Legal Actions in Progress and Possible Joint Measures

One of the most notable incidents occurred at the Hold The Door Club. A complaint has currently been filed in the First Investigating Court of Arona.

The owners of this and other clubs are considering taking legal actions they deem appropriate against the City Council and the National Police for the abuses they claim to have suffered. Several owners have already filed individual complaints regarding the police actions. To date, two complaints have been submitted, and the remaining ones are expected to follow the same course to clarify the situation and prevent these violations of rights from going unpunished.

«What has happened in recent months is unacceptable,» concludes one of the affected. «We have been victims of operations that violate our most basic rights, and we expect justice to act and put an end to this situation.»
