PABF warns the process could undermine the credibility and impartiality of the international tribunal

The Pan-African Business Forum (PABF) has officially requested that the International Criminal Court (ICC) suspend the ongoing investigation into its chief prosecutor, Karim Khan KC, arguing that the process could compromise confidence in the institution.
In a letter delivered in The Hague to Ambassador Päivi Kaukoranta, President of the ICC Assembly of States Parties, PABF President Ladislas Prosper Agbesi expressed “deep concern” over the impartiality of the proceedings. According to Agbesi, irregularities reported by whistleblowers and a lack of transparency threaten to “erode the credibility of international justice.”
Khan, who assumed office in 2021, has been on leave since late last year following allegations of inappropriate sexual conduct. Meanwhile, his deputies are managing the Office of the Prosecutor during the external investigation.
The PABF also reported possible undue diplomatic pressures within the process, noting that a Ugandan official allegedly attempted to influence the succession of the prosecutor through improper contacts with one of the whistleblowers.
The African forum called for an independent and fair review, emphasizing that “justice must not only be done, but must also be seen to be done,” stressing that the ICC’s credibility is essential for its global mission.
