The Guinean League for Human Rights (LGDH) denounced that democratic legality and constitutional order are under threat due to a «fabricated legal-political crisis created to serve undisclosed interests.»
The denunciation was made public by the president of the Guinean League for Human Rights, Bubacar Turé, during a press conference, where he announced the submission of a letter to the Attorney General’s Office requesting the initiation of criminal proceedings against Judge Conselheiro Lima André.
In the letter, the Guinean League for Human Rights stated that the crisis represents a delaying tactic by the current political regime to consolidate the subversion of the democratic order and remain in power “illegally,” with “the proactive participation of the Supreme Court of Justice.”
According to the League, for some time now, the highest instance of the Guinean judicial system has become an instrument of political influence for the President of the Republic, a pattern that has been systematically and recurrently used by the Supreme Court of Justice (STJ).
The League asserted that this behavior has significantly contributed to undermining the already fragile trust of citizens in the justice system, the magnitude and severity of which “stem from the arrogance of Judge Conselheiro Lima André,” specifically, the usurpation of functions through the arbitrary exercise of prerogatives reserved for the President of the STJ.
“He has worked in collusion with the current political power to undermine the independence of the judiciary through arbitrary dismissals, forced retirements, and illegal suspensions of judges who have ruled on political cases in accordance with the law and their conscience, in line with the Constitution of the Republic,” reads the letter presented by Bubacar Turé.
In the letter, the League deemed the statement issued by the President of the Supreme Court of Justice «null and void» due to procedural flaws, arguing that “the entity that requested clarification on the matter lacks the legitimacy to do so, as it was not a party to the case that led to the ruling.”
According to the League, in terms of jurisdiction, the clarification should have been provided by the full Supreme Court of Justice, meaning the group of judges who issued the ruling.
The League stated that the clarification suffers from formal and substantive defects, as it was issued by someone without the authority to do so, outside the timeframe stipulated by law, and concerning a matter that was not part of an electoral dispute, as regulated by ruling No. 06/2020, dated September 4.
Given the facts outlined in the letter and within the framework of the social duty to ensure the consolidation of democracy and the rule of law, the League urged the Public Prosecutor’s Office to initiate appropriate criminal proceedings against Judge Conselheiro Lima António André. His actions, according to the League, objectively indicate the commission of crimes listed in the Penal Code and the Law of Political Office Courts, including malfeasance, usurpation of office, an attack on the Constitution of the Republic, abuse of power, and document falsification.
It is worth noting that the President of the Supreme Court of Justice, Judge Conselheiro Lima André, issued a ruling on February 4, 2025, regarding the end of the President of the Republic’s term, in which he determined that President Sissoco Embaló’s mandate would only end on September 4. Until then, he must remain in power unconditionally until the new elected president takes office.
